Welcome to Whim. These Terms of Service ("Terms") are a plain-English agreement between you and Stratega ("we," "us," "our") that covers your use of the Whim mobile app and any related services (together, the "Service"). By downloading, installing, or using Whim, you agree to these Terms. If you don't agree, please don't use the app.
What Whim is
Whim suggests date-night ideas for two people. Suggestions are for entertainment purposes only. They are not professional advice of any kind — not relationship advice, medical advice, financial advice, legal advice, or anything similar. You and your person decide what's right for you and act using your own judgment.
Act safely
Date ideas might mention activities involving food, drink, travel, the outdoors, physical activity, or other real-world situations. You are responsible for your own safety— and the safety of anyone with you — when choosing whether and how to do anything Whim suggests. Use common sense. Check allergies, weather, local laws, traffic, your own limits, and anything else that matters. Don't do anything you're not comfortable with.
Acceptable use
When using Whim, you agree not to:
- Use the app for any unlawful or harmful purpose.
- Reverse engineer, decompile, or attempt to extract the source code, except where the law expressly allows it.
- Interfere with the app's normal operation, security, or the advertising it serves.
- Resell, redistribute, or commercially exploit any part of the Service.
Intellectual property
Whim — including its name, logo, branding, design, copy, illustrations, and all software — is owned by Stratega and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use, subject to these Terms.
"As is" — no warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement. We don't promise that Whim will always work perfectly, be uninterrupted, or produce any particular outcome for your relationship or your evening.
Limitation of liability
To the maximum extent permitted by applicable law, in no event will Stratega, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability arising from or related to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim arose, or (b) US $50.
Advertising
Whim is free and supported by ads served through Google AdMob. Ads are provided by third parties and we don't endorse, verify, or take responsibility for their content or for any products or services they promote. See our Privacy Policy for how the ad network handles data.
Changes to the Service or Terms
We may improve, change, or discontinue parts of the Service at any time. We may also update these Terms occasionally. When we do, we'll change the effective date at the top of this page. Material changes will be surfaced inside the app. Your continued use of Whim after changes take effect means you accept the updated Terms.
Termination
You can stop using Whim and uninstall the app at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to other users, to Stratega, or to third parties.
Governing law
These Terms are governed by the laws of the State of California, United States of America, without regard to its conflict-of-laws principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
